Il d\u00e9crit d\u2019abord les principes sur lesquels reposent les notions de \u00ab gouvernement transparent \u00bb et d\u2019\u00ab audiences publiques \u00bb, puis les principes de confidentialit\u00e9 en mati\u00e8re de s\u00e9curit\u00e9 nationale, c\u2019est-\u00e0-dire les motifs qui sont invoqu\u00e9s pour justifier la n\u00e9cessit\u00e9 de pr\u00e9server le secret. L\u2019auteur examine ensuite comment les lois en mati\u00e8re d\u2019information au Canada prot\u00e8gent la confidentialit\u00e9 des questions de s\u00e9curit\u00e9 nationale et dans quelle mesure celles-ci r\u00e9ussissent \u00e0 concilier les exigences de transparence et de s\u00e9curit\u00e9 nationale, en signalant certains probl\u00e8mes pratiques et structurels qui compromettent cette conciliation. Ces probl\u00e8mes font dire \u00e0 l\u2019auteur que les lois en mati\u00e8re d\u2019information et leur mise en pratique laissent grandement \u00e0 d\u00e9sirer au Canada.<\/p>\n<p>Certaines observations des milieux m\u00eames du renseignement et de la s\u00e9curit\u00e9 am\u00e8nent \u00e0 penser que l\u2019\u00e9tendue de la confidentialit\u00e9 pr\u00e9vue dans les lois d\u00e9passe les besoins de protection l\u00e9gitime. L\u2019incoh\u00e9rence de ces lois \u2014 de m\u00eame que l\u2019incertitude et les r\u00e9clamations excessives qu\u2019elles entra\u00eenent \u2014 cr\u00e9e des conditions susceptibles de freiner les \u00e9changes d\u2019information utiles et de miner par cons\u00e9quent la cr\u00e9dibilit\u00e9 des services de s\u00e9curit\u00e9.<\/p>\n<p>L\u2019auteur note que les limites impos\u00e9es par les lois encadrant l\u2019acc\u00e8s \u00e0 l\u2019information \u2014 et les p\u00e9nalit\u00e9s draconiennes pr\u00e9vues dans certains cas \u2014 sont nettement incompatibles avec la d\u00e9mocratie qu\u2019elles sont cens\u00e9es prot\u00e9ger. Leur ambigu\u00eft\u00e9 est telle qu\u2019elles pourraient \u00eatre utilis\u00e9es par le gouvernement pour \u00e9viter les situations embarrassantes et masquer les\u00a0 cas\u00a0 d\u2019incomp\u00e9tence,\u00a0 au nom de la s\u00e9curit\u00e9 nationale. Si cela se produisait, ces lois amoindriraient la confiance de la population, ce qui risquerait d\u2019entra\u00eener des correctifs qui rendraient plus difficile la protection de secrets l\u00e9gitimes.
