{"id":13447,"date":"2019-05-29T07:55:11","date_gmt":"2019-05-29T11:55:11","guid":{"rendered":"https:\/\/irpp.org\/?post_type=research-studies&#038;p=13447"},"modified":"2019-05-28T11:27:26","modified_gmt":"2019-05-28T15:27:26","slug":"renewed-canadian-senate-organizational-challenges-relations-government","status":"publish","type":"research-studies","link":"https:\/\/irpp.org\/fr\/research-studies\/renewed-canadian-senate-organizational-challenges-relations-government\/","title":{"rendered":"The Renewed Canadian Senate: Organizational Challenges and Relations with the Government"},"content":{"rendered":"<p>Le fonctionnement du S\u00e9nat et les relations du S\u00e9nat avec le gouvernement ont sensiblement \u00e9volu\u00e9 depuis que le gouvernement lib\u00e9ral a annonc\u00e9 en 2015 l\u2019instauration d\u2019un nouveau processus de nomination \u00ab\u00a0non partisan et fond\u00e9 sur le m\u00e9rite\u00a0\u00bb \u00e0 la Chambre haute. Avec la suppression du favoritisme politique\u00a0\u2014 \u00e9l\u00e9ment cl\u00e9 de l\u2019ancien processus \u2014, le Groupe des s\u00e9nateurs ind\u00e9pendants (GSI) d\u00e9tient maintenant la majorit\u00e9 des si\u00e8ges (58 sur 105 en mai 2019) d\u2019un S\u00e9nat d\u00e9sormais plus ind\u00e9pendant.<\/p>\n<p>Contrairement \u00e0 certaines voix critiques qui s\u2019inqui\u00e8tent de cette transformation, \u00adEmmett Macfarlane juge favorablement les changements adopt\u00e9s. Le S\u00e9nat n\u2019a tent\u00e9 de bloquer ouvertement aucune disposition l\u00e9gislative, pas plus qu\u2019il n\u2019a entra\u00een\u00e9 la Chambre des communes dans un aller-retour incessant pendant l\u2019\u00e9tude des projets de loi. Et si le nombre des modifications qu\u2019il a propos\u00e9es a notablement augment\u00e9, il s\u2019est chaque fois pli\u00e9 \u00e0 la volont\u00e9 de la Chambre (et du gouvernement) de les accepter ou de les rejeter.<\/p>\n<p>Mais pour le gouvernement, l\u2019ind\u00e9pendance plus grande du S\u00e9nat a manifestement accru l\u2019exigence et la complexit\u00e9 du processus l\u00e9gislatif. Il s\u2019est notamment heurt\u00e9 \u00e0 un probl\u00e8me organisationnel pour faire adopter son programme l\u00e9gislatif par le S\u00e9nat\u2008: la majorit\u00e9 des s\u00e9nateurs n\u2019appartenant plus \u00e0 un caucus de parti, le gouverement ne pouvait plus compter sur un bloc de s\u00e9nateurs qui \u00e9taient \u00ab\u00a0sur la m\u00eame longueur d\u2019ondes\u00a0\u00bb que lui. Les ministres ont vite compris qu\u2019ils devaient intensifier leurs efforts pour s\u2019informer de l\u2019avis des s\u00e9nateurs sur certains projets de loi, r\u00e9pondre \u00e0 leurs interrogations et obtenir leur appui.<\/p>\n<p>Pour leur part, les fonctionnaires ont constat\u00e9 qu\u2019il leur fallait parfois adapter leurs m\u00e9thodes, en multipliant par exemple les s\u00e9ances d\u2019information technique pour des s\u00e9nateurs r\u00e9unis en petits groupes, qui repr\u00e9sentaient l\u2019\u00e9ventail des points de vue au sein du GSI. Enfin, le nouveau Bureau du repr\u00e9sentant du gouvernement au S\u00e9nat (cr\u00e9\u00e9 en 2016) a jou\u00e9 un r\u00f4le important en assurant le suivi des projets de loi et en n\u00e9gociant les calendriers.<\/p>\n<p>En somme, conclut Macfarlane, certains des pr\u00e9tendus probl\u00e8mes soulev\u00e9s par la transformation du S\u00e9nat pourraient constituer une fonctionnalit\u00e9 plut\u00f4t qu\u2019une source d\u2019ennui. \u00c0 la fois plus dynamique et r\u00e9ceptif, un S\u00e9nat plus ind\u00e9pendant imposera in\u00e9vitablement un surcro\u00eet de travail au gouvernement et ajoutera \u00e0 la complexit\u00e9 du processus l\u00e9gislatif. Mais d\u00e9lest\u00e9 de son r\u00f4le n\u00e9gatif d\u2019institution client\u00e9liste ou simplement partisane, le S\u00e9nat pourrait fort bien retrouver une l\u00e9gitimit\u00e9 perdue. Il n\u2019en reste pas moins en pleine transition, et d\u2019autres changements \u00e0 ses r\u00e8gles seront sans doute n\u00e9cessaires pour consolider cette
